The Manhattan district attorney has also assigned a senior sex crimes prosecutor to the case, working in collaboration with NY police, his office confirmed.
Speaking to Vanity Fair, De Le Huerta said that Weinstein insisted on having a drink at her apartment in NY after offering her a ride home from a hotel in October 2010.
The NYPD says the attacks are alleged to have happened in 2010, and add they would need to obtain an arrest warrant, noting Weinstein is out of state.
"He pushed me on the bed... and it happened all very suddenly", she told CBS News over the phone.
On December 23 of the same year, she says Weinstein showed up in the lobby of her apartment building, they went upstairs, and he allegedly raped her a second time.
Investigators in London and California were also looking into allegations made by women, but no other department has suggested allegations could result in criminal charges.
De la Huerta follows dozens of women who have come out against Weinstein alleging sexual harassment or assault.
