High Court refuses interim relief to disqualified AAP MLAs

In its opinion sent to President Ram Nath Kovind this morning, the Election Commission said the MLAs, by occupying the post of parliamentary secretaries between March 13, 2015 and September 8, 2016, held office of profit, and were liable to be disqualified as legislators, highly-placed sources said.

They have subverted the constitutional norms of the government in the capital and misused the official machinery appointing parliamentary secretaries and total disregardance of the laid down norms, rules and regulation concerning the government.

Dr Cheema said AAP was resorting to such cheap tactics because it was afraid of facing the people. Since then, the BJP has viewed the AAP as a potential threat and was waiting to see the party discredited.

BJP will gain significant margin in the seats if the Delhi Bypolls are conducted given the significant importance of this election in the 2019 General Election.

The President is bound to go by the recommendation of the Commission. Later on Friday, the Delhi High Court refused to grant interim relief to AAP MLAs against the EC's recommendation. Though 20 MLAs have been disqualified it will not lose its majority. Disqualification of the MLAs will not threaten immediate existence of the AAP Government but by-elections in these seats could be a referendum on Kejrriwal administration. Then Kejriwal introduced the Bill without seeking prior approval from LG (remember Delhi is a partial state and LG is the executive head).

Welcoming the EC's decision, the BJP said Delhi CM Kejriwal should immediately resign.

"Kejriwal has no right to continue.of his cabinet ministers removed on corruption charges!"
